THEHAKAI™️ Inc, Shipping Insurance
COVERAGE RULES FOR THE THEHAKAI SHIPPING INSURANCE PROGRAM
1. Definitions:
- Carrier: Refers to the company responsible for transporting the Parcel covered under this program.
- Insured: Refers to individuals who purchase insurance through this program.
- Parcel: Packages or shipments transported by parcel carriers.
- Goods: THEHAKAI™️ products purchased on the order containing the purchased insurance.
- THEHAKAI™️: Refers to the agent, THEHAKAI INC., a company registered in Cape Cod, Massachusetts.
- Total Insured Value: The total value of the item(s) declared for insurance coverage, which may include shipping fees and any carrier-provided coverage.
- Order: A valid order placed by the Insured on the website www.thehakai.com that includes purchased insurance.
- We, Us, and Our: Refer to THEHAKAI™️.
- Theft: Refers to a Parcel stolen outside a residence or business after commercial delivery, with the intent to deprive the rightful owner of the contents.
2. Coverage:
THEHAKAI Shipping Insurance provides protection against risks of physical loss or damage from external causes (subject to exclusions) while in transit and physical loss or damage due to theft upon delivery.
Coverage Details:
- Applies exclusively to packages purchased through www.thehakai.com.
- Covers the loss, damage, or shortage of the original merchandise shipped and the declared shipping cost (if applicable).
- Does not cover inbound shipments.
By purchasing this insurance, you acknowledge that the coverage is provided by THEHAKAI INC., which acts as a non-admitted insurer.
3. Limits:
- Coverage applies only to Goods within the Parcel insured by THEHAKAI Shipping Insurance.
- If an Order involves multiple Parcels, only the affected Parcel is covered.
- Coverage includes one (1) reshipment of Goods under a claim.
- Insurance does not cover Orders shipped to incorrect addresses provided by the Insured.
4. Conditions of Insurance:
Claim Disputes
This program is governed by the laws of the State of Massachusetts. Any disputes arising from the program must be resolved in Barnstable County, Massachusetts.
The Insured agrees to indemnify and hold harmless THEHAKAI INC. from any losses, liabilities, or costs resulting from failure to comply with the program’s terms and conditions.
Claim Requirements
To process claims:
- Retain all packaging and damaged Goods in their original state.
- Submit claims to infohakai.usa@gmail.com with the subject line: CLAIM for Order #[Order Number]. Include a detailed description of the issue.
- Provide all required documentation within 15 calendar days from the date of shipment.
Once a claim is approved, reshipment will be made to the address on file. For losses involving the United States Postal Service (USPS), claims for lost Parcels must wait 20 days (domestic) or 40 days (international) for USPS to confirm the loss.
5. Other Insurance:
If other insurance coverage exists, THEHAKAI Shipping Insurance serves as excess coverage, providing additional protection up to its limit.
